Acceptance of Terms

By accessing and using the Art Booth website and platform, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use this website or platform.

Description of Service

Art Booth provides a platform that enables artists to create storefronts, showcase artworks, and sell directly to collectors. The platform includes tools for portfolio hosting, order management, payment processing, and analytics.

User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Artists must provide accurate business information, including tax identification and bank account details, to receive payouts. You must promptly update this information if it changes.

Payment Terms & Stripe Connect

Art Booth uses Stripe, Inc. to process payments. By selling or purchasing through the platform, you agree to Stripe's terms of service and privacy policy.

Art Booth acts as a payment facilitator. Artists are independent contractors and not employees of Art Booth. Art Booth collects payments on behalf of artists and remits the artist's share (minus applicable platform fees) via Stripe Connect.

Platform fees are deducted from each transaction as displayed at checkout and in the artist dashboard. All fees are non-refundable except where required by law.

Payouts to artists are initiated according to the schedule configured in the artist's Stripe Connect dashboard, subject to Stripe's holding periods and compliance reviews.

Prohibited Activities

You may not use the platform for any unlawful purpose or to sell prohibited goods or services as defined by Stripe's prohibited businesses list, including but not limited to: counterfeit goods, illegal drugs, weapons, gambling services, or adult content.

You may not scrape, copy, or redistribute platform content without permission. You may not interfere with the platform's security or transmit harmful code.

Refund & Chargeback Policy

All artwork sales are final unless the artwork is damaged during shipping or materially different from its description. Buyers must contact the artist and Art Booth support within 48 hours of delivery to report issues.

Chargebacks initiated by buyers will be handled in accordance with Stripe's dispute process. Artists may be required to provide evidence to resolve disputes. Art Booth reserves the right to withhold payouts related to disputed transactions.

Intellectual Property

All images, text, and content on the Art Booth website are the intellectual property of Art Booth or its respective artists and are protected by copyright law. The purchase of an artwork does not grant reproduction rights unless explicitly agreed in writing.

Limitation of Liability

Art Booth is not liable for any indirect, incidental, or consequential damages arising from your use of the platform or the purchase of artwork. Our total liability shall not exceed the amount paid for the specific transaction in question.

Art Booth does not guarantee continuous, uninterrupted access to the platform and is not responsible for delays or failures caused by circumstances beyond our reasonable control.

Governing Law

These Terms of Service are governed by the laws of the State of Florida, USA. Any disputes shall be resolved in the courts of Pinellas County, Florida.

Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the revised terms. We will notify users of material changes via email or platform notice.
